Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Lascava website at lascava.com (the "Site") and any purchase made through it. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

These Terms work together with our other policies — Privacy Policy, Cookie Policy, Shipping Policy, Payment Policy, Exchange and Return Policy, and Buyer Protection Policy — which are incorporated by reference.

References in these Terms to "Lascava," "we," "us," or "our" refer to Lascava Sp. z o.o.

2. Eligibility

The Site is intended for adult users aged 18 or over. By using the Site or placing an order, you confirm that you are at least 18 years old and that you have the legal capacity to enter into binding agreements under the law of your country of residence.

3. Account registration

You may browse the Site without creating an account, but registration is required to place orders, save items to a wishlist, or view order history. When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Keep your account credentials confidential
  • Notify us promptly if you suspect unauthorized access to your account

You are responsible for activity carried out under your account. You may request deletion of your account at any time by emailing info@lascava.com. Account deletion is processed within 30 days, in line with your rights under the General Data Protection Regulation (GDPR).

4. Products and pricing

Lascava is a multi-brand retailer of European lingerie and hosiery. Products are sourced directly from manufacturers and authorized distributors. Brand names, logos, and product designs are the property of their respective rights holders.

All prices on the Site include VAT at the rate applicable in Poland (currently 23%). Prices are displayed in USD by default and can be switched to EUR or GBP. Shipping costs are shown separately at checkout.

We make every effort to display accurate prices and product information. In the event of an obvious pricing error, a stock listing error, or a clearly incorrect product description, we reserve the right to cancel the affected order before dispatch and refund the full amount paid. We will notify you by email if this occurs.

5. Order placement and acceptance

Placing an order on the Site is an offer by you to purchase the selected products. An order is confirmed only when we send you an order confirmation email. Until that point, we may decline to fulfill the order — for example, if a product becomes unavailable, if there is a pricing error, or if the order cannot be shipped to your country.

Order details, including delivery times and shipping costs, are governed by our Shipping Policy.

6. Payment

Accepted payment methods, currency conversion rules, and payment security are set out in our Payment Policy. By placing an order, you authorize the charge for the full order amount, including shipping, to your selected payment method.

7. Shipping and delivery

Shipping rates, delivery times, supported destinations, and shipping restrictions are set out in our Shipping Policy. We do not currently ship to Russia, Belarus, Iran, or regions affected by active armed conflict.

Risk of loss and title for the products pass to you upon delivery to the address you provided at checkout. If a parcel is delayed or does not arrive, we work with the carrier to resolve the situation as described in our Buyer Protection Policy.

8. Returns, exchanges, and consumer rights

Customers in the European Union, the United Kingdom, and other jurisdictions with comparable laws have a statutory right to withdraw from a distance contract within 14 days of receiving the goods, subject to applicable exceptions. Lascava honors this right, with the exceptions for hygiene-sensitive intimate products listed in our Exchange and Return Policy.

The Exchange and Return Policy is incorporated by reference into these Terms and forms the complete agreement on returns and exchanges.

Nothing in these Terms limits or excludes statutory rights you have under the consumer protection laws of your country of residence.

9. Intellectual property

All content on the Site — including the Lascava name, logo, layout, design, text, and original photographs — is owned by Lascava Sp. z o.o. or licensed to us, and is protected by copyright, trademark, and other intellectual property laws.

Brand names, product names, and product images of the brands we sell (Gorsenia, Mediolano, Mefemi, and others) remain the property of their respective rights holders. Lascava distributes these products under standard retail and distribution arrangements.

You may not copy, reproduce, redistribute, or use any content from the Site for commercial purposes without our prior written consent.

10. Acceptable use

You agree not to:

  • Use the Site for any unlawful purpose or in a way that violates these Terms
  • Attempt to gain unauthorized access to the Site, our systems, or other users' accounts
  • Interfere with the Site's operation, including through the use of bots, scrapers, or denial-of-service techniques
  • Use the Site to transmit harmful code, malware, or unsolicited communications
  • Misrepresent your identity or place orders fraudulently

We reserve the right to suspend or terminate accounts and refuse orders that violate these provisions.

11. Privacy and data protection

Personal data you provide is processed in accordance with our Privacy Policy, which describes what data we collect, how we use it, and your rights under the General Data Protection Regulation (GDPR). Use of cookies on the Site is described in our Cookie Policy.

12. Limitation of liability

To the extent permitted by law, Lascava's total liability for any claim arising out of or relating to your use of the Site or any product purchased through it is limited to the amount you paid for the relevant order.

This limitation does not apply to liability that cannot be excluded under mandatory consumer protection law, including liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be limited.

We are not liable for indirect or consequential losses, loss of profit, or loss of opportunity arising from your use of the Site, except where such liability cannot be excluded under applicable law.

13. Force majeure

We are not liable for any failure or delay in performing our obligations under these Terms when the failure or delay results from causes beyond our reasonable control, including natural disasters, acts of war or armed conflict, civil unrest, government actions, pandemics, prolonged disruption of telecommunications or payment systems, or carrier service interruptions. We will take reasonable steps to mitigate the impact and resume normal service as soon as practicable.

14. Changes to these Terms

We may update these Terms from time to time to reflect changes in our services, applicable law, or business practices. The "Last updated" date at the top of this page indicates when the Terms were last revised. Material changes will be communicated by an announcement on the Site or by email to registered users. Your continued use of the Site after the updated Terms take effect constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions remain in full force and effect. The invalid provision will be replaced by a valid provision that most closely reflects the original intent.

16. Governing law and dispute resolution

These Terms are governed by the laws of the Republic of Poland, without regard to conflict-of-law principles.

For consumers resident in the European Union, this choice of law does not deprive you of the protections granted by the mandatory consumer protection laws of your country of residence. You may also bring legal action in the courts of your country of residence in accordance with EU consumer law.

For consumers outside the European Union, disputes will be resolved by the courts of competent jurisdiction in Poland, unless mandatory law in your country of residence provides otherwise.

EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr for out-of-court resolution.
